Foreclosure stages

How the New York foreclosure process works

A mortgage foreclosure is a lawsuit. The public record may show the complaint, conferences, motions, orders, referee activity, judgment and sale information as the case moves forward.

Before a court case

A homeowner may receive payment notices, loss-mitigation communications and a pre-foreclosure notice. This is the time to contact the servicer and qualified housing or legal assistance.

When the lawsuit begins

The filed case generally identifies the plaintiff, defendants, property and index number. The homeowner may receive a summons and complaint and must pay attention to response requirements.

Court activity and possible sale

A residential case may include settlement conferences, motions, an order of reference, a referee report, a judgment of foreclosure and sale, and auction information. Not every case follows the same timing.

Important: Foreclosure Case Review provides general information and reviews available public records. It is not a law firm and does not provide legal advice. A request does not create an attorney-client relationship, file a court response or pause any deadline. For an urgent deadline, auction or court appearance, contact a New York-licensed attorney promptly.
